Is the Board and HOA remaining Neutral in the recall election?

​This past Friday afternoon, the HOA and Board sent out a Newsletter on Condo Communities labeled “Misinformation”.  The Board has decided that any information that was not provided by the board is “Harmful” to the community and the HOA has a responsibility to reinforce information that was already sent out by Peter Webb to all homeowners to defend his actions.

This raises the following questions:

  • Is it proper for the Board to direct the HOA to use staff time, resources and Condo Communities to send a Newsletter defending  positions taken by Peter Webb during the recall election?  

  • Why did 6 of the 7 Board members decide not to remain neutral during the recall election? 

  • Are homeowners being “Harmful” when they ask for additional details or facts to help them understand the actions of the Board?

  • Do you believe that the HOA will provide homeowners with any supporting data and facts to dispel the “Misinformation” that was referenced  in this Newsletter?

The Peter Webb recall Ballots Are in the mail

The Peter Webb recall ballots are in the mail.  Some homeowners have already received their ballots.

This recall is an opportunity for every homeowner to make their feelings known.
We elect our board members to represent all homeowners , be respectful and communicate openly,  make informed business decisions and control our expenses.   All votes matter.

Peter Webb has promised to resign immediately if he is successfully recalled.  If this happens, his open board position will be filled at the annual election.  If the recall fails,  Peter Webb will continue to be a board member until his term is up in 2023.

The recall why now and what are the facts?


  • The recall is not frivolous; Peter Webb’s term does not expire until 2023.

  • Peter Webb has stated that he will step down if he is recalled before his term is up in 2023.  Peter has no choice. The recall will end his term as a board member.

  • Peter Webb has stated that recall election contract was approved for up to $12000.  However, he failed to mention that the actual cost is closer to $6000.

  • There is currently three board positions open for the next annual election.  If Peter Webb is recalled, there will be four board positions open for the next annual election.

  • This month, the board will be voting for a replacement of a board member that resigned. This is not a recall related event.  The board will either select an existing committee member or reach out to the community for the board member replacement. 

  • 3 of the 4 testimonials for Peter Webb were from existing HOA committee members appointed by Peter and the board.  All of these testimonials vouched for him personally but did not state what he has done for the community.

Recall Facts vs Testimonials

Do you know that Peter Webb’s term as a board member expires February of 2023?  The recall will terminate his position immediately.

Once the recall petition was accepted by the HOA Board (9/13/21), the Board of Elections manages the recall election just like the yearly board elections.  The Board is no longer directly involved.

Why are the testimonials only from current/ previous board members and existing board appointed committee members?

The recall committee has been providing facts.  Why has the board only addressed the fact that non-profits cannot take tax credits?  Does this mean that the rest of the recall facts are correct?

The recall committee is being called “armchair quarterbacks”.  Who has been an “Armchair Quarterback” for last 19 months, Peter Webb?

Our Solar Project Revisited

The HOA has just sent out a copy of the Solar Power Proposal that was produced in 2018.  A proposal is the starting point.  Where is the executed contract that represents the business arrangement the Board entered into for our Solar Facility at the Country Club?
 
For example:
  • Were there additional cost that DPPS incurred during the project installation, such as electrical re-wiring, repaving , etc.?

  • What were the actual legal fees charged during the three year period from proposal to completion of installation?

  • Does the actual contract provide the same financial benefits as this proposal?

  • In what year will the solar project break even?

  • How many batteries did we purchase and at what cost?

  • Was the estimated cost saving provided by the vendor?  Did the board seek an independent analysis to verify the projected savings?

  • Now that the system is on-line, are we getting the savings that were predicted?
