The recall petition for hoa president Peter Webb

Have you seen the email with the recall petition?  In case you missed that email, the links  to the recall Letter and petition are provided below:

This raises a number of questions:

  • Can the recall serve as an effective way to institute the change in the relationship between the Homeowners and the Board?

  • Can a board member change ,put the HOA on a path towards cost containment and limit future increases in dues and fees?

  • Can we move towards board transparency?

  • Can the recall start the process of managing the HOA as a business that bases decisions on how it affects the bottom line?

The answer to all four blog questions is an emphatic Yes. The plandemic has been hard on our society, our way of life and our businesses. That being said, we must get creative and more efficient with how things operate at D.P.C.C.
We must market and promote our beautiful community and it's amenities to increase our revenue streams. Raising HOA dues and having valid reasons for doing so is one thing but not having these valid reasons is another and is unsatisfactory. What we need to remember is that we are one big community/family. We need to take care of it and those that support it...we the homeowner.

This is among the most stupid ideas I have heard this year and there have been plenty of them. We have board elections every year. It is only a few months until the next one. I have read the petition letter and I do not understand what they are complaining about aside from the unusually large increase in the maintenance. I am waiting to see what the offset will be in my Spectrum bill. Peter Webb has been my next door neighbor at the Desert Princess for more than twenty years. I can assure everyone he is not arrogant, spiteful or unfair. You can disagree with a board decision, but to try to vilify Peter is absurd and unfair.

You must not have been present during the zoom meeting last month to see it for yourself. It was shameful the arrogance and character that was shown.

Hi William L,
The next board election, does not include Peter Webb. Peter Webb is not up for re-election yet.
There are major issues under Peter's leadership. Such as many many topics of discussion taking place in closed executive sessions that are not permitted and should be discussed in open and transparent meetings for all to hear. That is unlawful. That is just one of many areas of concern.
In regard to your personal dynamics and interaction with Mr. Webb: I am happy to hear that your interactions with him have been positive. Unfortunately, that is not the case for many others. I have to assume that you do not attend or listen to the actual board meetings themselves. Homeowners and one board member in particular, are regularly publicly shamed and disrespected by Mr. Webb to a disturbing degree. With all due respect, if your mother or sister had been treated the way Mr. Webb has spoken to some of the homeowners here as he has, you would feel differently than you currently do.

The recall only helps to produce bad blood in the community, it’s costly of time, better spent on things that matter, serving on the board is a thankless job, we should be respectful to the volunteers that run and get elected, Dessert Princess is not USA senate , one can disagree on matters and still be respectful, you always have the choice of running for the board in next election and if you get elected hopefully you get respected as well. I have seen over the years that that most members of the board have intentions to do well for the community, some achieve results favourable and some don’t, I like my desert princess community, and I thank you all for your time spent helping the community. Just stay civilized.

Peter Webb is NOT at all respectful and I have witnesed this myself at every single board meeting I've watched on Zoom AND in person in July. He rudely interrupts owners who are speaking at the start of the meetings. He reads letters written by owners in a rude tone. He is rude to other board members AND he does pretty much what he pleases. The other board members give in to him, and some people say they are afraid of him. The decision to spend $15,000 of our money to pay an Architect to come up with a redesign of the clubhouse patio - when we are STILL having low turnout for dining, golfing, etc and we don't even know how this coming winter will be - is nothing less than an egregious waste of our money. He doesn't live here, doesn't see the deteriorating pool fences, trees, etc. It's time for him to go!!

Without taking a side in this discussion (yet), I feel I should point out a few things. Recalls cost a lot of money: management time, mailings, Inspector of Elections, erc. Also, changes to recall requirements in Davis-Stirling made by SB323 can make the recall process very complicated, due to conflicts in Bylaws and State law. Such conflicts inevitably lead to the need for legal assistance, which also costs money. Effecting change in this type of situation is more efficiently accomplished by exerting political pressure within the BOD and the community, by either convincing the Board President to step down, or resign from the Board. Additionally, if the President has the support of other Board members, it would be necessary to recall them as well. Otherwise, only the face will change, not the policies of the current Board.

Dear Barry,
Please take a look at the financials sent to you recently. A recall is much less costly than where we are headed under the leadership of Mr. Webb. Mr. Webb is leading our HOA right into possible near bankruptcy in just a few short years. Please look at the financials you were sent.
We did privately consult an attorney on behalf of the committee who facilitated the recall of Mr. Webb. (With private funds, not those of the HOA) We were advised that it would be best to proceed with a recall and to engage the community first, prior to seeking legal action. We were advised that it is less costly to the HOA, to proceed with a recall first prior to facilitating direct legal action, of which might I add, there is basis for. I hope that helps to put your mind at ease a little, knowing that was all taken into consideration first.

Not in favour of recall, let’s relax and vote in the next election, criticism of the board is okay but recall takes it to a level not necessary, if you have too much time in hand go play golf, will help you and the community. Thanks.

Dear Manual,
While I understand that it is easier and the path of least resistance to sit back and say let's all just go and play golf. However, if more don't start to engage and get involved with the facts of what is really taking place in our HOA, we will all be living in the DESPERATE PRINCESS once again. Now is not the time to take a back seat and sing kumbaya. This is serious. There are real issues here that need to be dealt with that require immediate action.

If your concerns are true, then I agree with the recall. Now, I am having difficulty viewing your email. For some reason it isn't fitting on the page making it difficult to read. The dropbox petition is award to work with as well. The form cannot be completed electronically.

Desert Princess needs to change. The disrespect and outright contempt the BOD displays towards homeowners greatly effects our quality of life. The tone deaf decision by the board to spend our money to move the women's tee on Lagos is a maddening and unnecessary expenditure of funds. Just another example of the real priority by our "leadership." While our fees are being increased the board is throwing money away to serve a select few. Time for a change.

It is unfortunate that things have gotten to the point where a recall is necessary. Please know that it was taken into consideration regarding "bad blood". This must be viewed from a greater perspective. There are unlawful activities taking place under Mr. Webb's leadership and gross financial irresponsibility. I need only to point your attention to the most recent 30 year reserve account forecast that was mailed out to all homeowners.
I agree that it should be the intention of all board members to serve the community at large. In this particular case, it is felt by many, that Mr. Webb is serving himself first. Again, look at the financials provided to you. That alone, speaks volumes. I find it absolutely insane that the board's response to one homeowner who posed the question about special assessments being imposed, and the board's answer was "no plans for such". That is absurd. Look at your financials people! Increased dues and special assessments are on the way. It is unavoidable with the way this board spends. It is unavoidable with a depleting reserve account like this. Do you even know how lenders see these kinds of financials and what that does to our property values when banks won't lend due to weak financials. This board is steering us into a high risk financial position with no plans of changing direction. If that doesn't concern you, that is concerning. Within 2 short years, it is projected that our reserve account falls in the high risk category. In addition to that, it is of importance to note, that $2.2 MILLION of that money will NEVER be found money. That money was settlement money for plumbing defects and is to be reserved for any and all future repairs for that purpose. PLEASE LOOK AT YOUR FINANCIALS.

so many emails come in - can you please direct us to the one you are referring to? I totally agree with what you say, and I see it myself. The easy peasy way that they approved spending $15,000 at the July meeting, for an architect to come up with plans for a clubhouse patio re-design just blew my mind! AND I got on the Fitness Center committee so I can keep an eye on what they want to spend on that........

Maggie, Thank you so much for serving on the fitness center committee. You made some good points and had some good ideas regarding the fitness center at the July BOD meeting. Appreciate your service!

Ann - Other then the reserve study, which is a matter of opinion whether there should be any concerns about it or not, what are your concerns about the financial statements? What should I be seeing that is so alarming? Thanks.

Helpful Information For All Regarding HOA Reserve Accounts
9/9/2021 08:51:26 am

Excerpted From https://www.hoamanagement.com/hoa-reserve-study/

"Why Are Reserve Studies for HOA Communities Necessary?
how to calculate HOA reserve fundReserve studies serve many purposes. First of all, they are necessary for the pursuit of good financial health for your community. These studies evaluate the status of your association’s reserves.

When you let your reserve funds remain underfunded, you run the risk of falling short on funds when the need for major repairs or replacements arises. And the only way to know whether or not you’re underfunded is to have a reserve study done.

In essence, reserve studies help your association circumvent financial crises. By ensuring funding for HOA projects, your board will have no need to impose special assessments or take out a loan. Both those alternatives, after all, aren’t popular choices among homeowners.

A reserve study can also indirectly provide for future members of the association. Current members use the HOA’s common areas and facilities on a regular basis. This will obviously result in wear and tear. Over time, as the damages accumulate, they will need replacing or major repairs. In a way, contributing to a reserve fund is the homeowners’ way of paying for the maintenance of the community."

"Should You Do an HOA Reserve Study?
The question remains — does your community need an HOA reserve study? The short answer is yes. Not only is it mandatory in many states, but a reserve study also helps gauge your association’s current and future financial condition. With a reserve study, you can determine how long your assets have left and how much it will cost to replace or repair them. This will ensure you don’t get caught by surprise and grapple for funds when the time comes."

Here is another helpful link regarding the significance of why HOAs do reserve studies;
https://cedarmanagementgroup.com/hoa-reserve-study-community/

"A reserve study helps maintain the property's value and the property owner's investment. By identifying and budgeting for future capital improvements, the property's common elements continue to look attractive and well-kept, adding to the community's overall quality of life."

"To establish sound financial planning and budget direction
A comprehensive reserve study lays out a schedule of major repairs or replacements to common property elements and applies cost estimates to them. To ensure property owners have adequate reserve funding to cover anticipated costs, a reserve funding plan typically spans 30 years. In short, it's your blueprint for the future."

Here is a helpful link regarding HOA reserve funds that is a helpful read as to the importance of them and the more global concerns that are affected by low reserve funds.

Mr. Littauer
Calling someone that came up with a well backed idea to recall Peter Webb stupid is pretty low on your part and I hope you do not continue this language.
I think that ALL Board meetings should be open meetings not private.
I also think that we all need to see who are the ones in the Board that bring up those "let's raise everything" ideas. I feel that few Board Members are decent and they should speak up when a wave of people disagree with some of their decisions.
I've heard Mr. Webb's comments in person and I think that he needs to be recalled.

Takis, your observations and comments are shared by hundreds of owners at DP. Unfortunately, many are reluctant to voice them publicly for fear of retribution. Thank you for your balance and courage in speaking up.
