"Open board meeting" /Zoom only

The agenda for the next special board meeting is now ZOOM only. 

THIS IS NOT AN OPEN MEETING

This raises a few questions:

  • Has the Board established a new policy that excludes in-person meetings?

  • Does the board believe in-person two way dialog incites a "riotous mob"?

  • Does the Board believe that restricting in-person two-way conversations protect them from probing questions?

  • Will the Board start muting Zoom participants at will and compromise homeowner's "due process"?

  • Who made this new policy decision?

The blog would like to hear your thoughts.

The more the Board makes these Meetings more secretive the more suspect they are to doing things not in the Community"s
Best Interests. Doesn't make sense why they keep these meetings so "close to the vest" amongst themselves . If they're not doing anything
"shady" why don't they let the Homeowners attend ? Just raises more questions as-to their Integrity and caring about the Community's
Best Interests. Sounds like PW is gonna get his last "Wish List" Items ram-rodded thru with his Cronies before his demise.

Any and every meeting should be open to homeowners. There should be transparency at all times. Absolutely no secrecy!!

Like I mentioned before, NOT all board members are the same. But we need to find the ones that start problems for the homeowners and get rid of them during the next elections.
We suppose to be in a peaceful and relaxing community and all we do argue among ourselves because of the board's actions.
Let's stop doing that and get rid of the bad apples....

The Board is elected to work on behalf of all owners.... Owners should all be aware of any Board member's proposals, ideas, and suggestions thereby providing total transparency for everyone.

I attended a meeting about a month ago via Zoom that Terri Swart the HOA Secretary CONTROLLED. I felt completely restricted and HOA members were only allowed to be called on one time to ask questions. As other homeowners asked questions or brought up issues of course it generated additional questions.
Being a fairly new owner (just over a year), being the first meeting I attended and with all of the issues that are being floated, I was completely put off by her very condescending attitude and her controlling that you were only allowed one chance to ask your question(s). Seriously? I know it was a Saturday but if we as HOA members have questions they have to give us the opportunity to speak. Not everything can be done via email. It isn't always an effective way to communicate. This should not be a dictatorship. We need to have a say in decisions that are made.

The primary purpose of a Board meeting is to transact Board business. All of us can attend this meeting by Zoom and it is an open meeting. I don’t understand the obsession some have with in-person attendance especially when we are still in a pandemic. A live audiences isn’t a requirement and based on the behavior of some at the Board meeting last week, it’s no surprise that this meeting is virtual only.

I hope blog readers submitted comments regarding the one agenda item to the Board during the 28 day comment period which ended today. In my comments, I tried to persuade Board members that the proposed amendment to rental rules and regulations is unnecessary and legally risky.

Unfortunately, our Board has been entirely reactive in dealing with rental property restrictions during the last 18 months, with an ongoing cascade of ever more arcane and onerous restrictions. Let’s encourage them to stop, take a step back, and start thinking strategically.

But bullying, yelling, chanting, exceeding speaking time and similar poor behaviors are not how we can persuade them. It’s difficult to have a dialogue with someone who yells and chants.

We need to establish a dialogue with Board members regarding rental rules and restrictions, and treat them with respect just as we expect to be treated.

Oh give me a break. That was minor and isnt it about time that someone try to stand up to that board- The homeowners that were brave enough to speak up had some meat to what they were saying. I don't think a second of chanting the word recall following the boards insisting on closing down the meeting with a room full of homeowners was that far off base.

I will tell you why in person meetings are important.
Emailing in questions to that board is like talking to a wall. Peter Webb never reads all of the emails. He hand selects them to his own personal liking. He often only summarizes them and rarely reads them in its entirety.
That board loves hands off meetings so that they can cut off homeowners as they please and censor them. Lots of us have experienced that first hand.
There are many more reasons to list.
Those two things though are enough said to plead a reasonable case for it.

The board otta think and ask themselves how we got here. If the board were doing its job no one would be so frustrated with them to start up a recall in the first place. People wouldn't go to the trouble of putting up signs. And people wouldn't feel the need to protest in a meeting. Besides at this point why not try it. No one else has done much else to date that has been effective. Nothing has changed. They don't listen and don't care what anyone else has to say that doesn't agree with them. So the board keeps dishing it to us. No one wants to have to deal with all of this. The only reason people are having to deal with this crap is because the board is not doing their job. They are self serving. They are disrespectful. They are financially irresponsible. They fine us to the hilt for anything they can get away with.
Its about time people start to stand up and say NO we won't take this from you anymore!

I recently received an email from homeowner Norm Stoehr. The first line of the email states “as an unpaid, duly elected volunteer Desert Princess HOA Board member”. I’m confused, which is it, homeowner or board member. As a board member both this and the previous email sent out are unethical and shows so much hatred towards the homeowners at Desert Princess. No homeowner dare disagree with the board, ask questions, have an opinion or ask for clarity on what is going on in our community.

The email goes on to say “had I been in the room” so why weren’t you in the room Norm? You live full time at Desert Princess. How can you make comments of what happened when you were not personally? Feared for your safety, really Norm. Were the police called? Did you see blood on any management staff or the one board member who was there in person? The only fear you should have is having Peter Webb as board president!

I attended the board meeting via zoom. The homeowners did not disrupt the board meeting. Homeowners have the right to speak and be heard. Each homeowner has 3 minutes to speak, maybe the answer to their question should also be limited to 3 minutes rather than President Webb going on for 15 minutes on one response. We need a board president who will attend the board meetings in person. RECALL PETER WEBB!!!

This morning a Patrol Services officer knocked on the door of a condo displaying a RECALL PETER WEBB sign and asked the occupants to remove it. A cordial and quiet discussion ensued and an agreement was reached to remove the sign. I urge everyone to treat our Patrol Services personnel with courtesy and respect. They don't make the rules. They are required to execute the orders from above and I would suspect if you don't want to be recalled, you would order the staff to remove the signs. Petty, petty, petty. All the more reason to RECALL PETER WEBB.

It's interesting that just 9 months ago during the 2021 board member general election when Bill Bergstrom's and Hank Kras' respective seats were up for grabs, yard signs in condo and villa planting areas were perfectly acceptable. And prior to that in 2020 when Peter Webb's and Don Milligan's respective seats were on the block, yard signs in condo and villa planting areas were perfectly acceptable. Even going back to the 2019 pre-pandemic election when Russ Holowachuk's, Hal Katkov's and Norm Stoehr's respective board seats were ready to be filled, yard signs in condo and villa planting areas were perfectly acceptable.

But suddenly during this "Recall Peter Webb" ballot not only have the rules for yard signs in the condo planting areas been changed to disallow "political" signage, but the board under Peter Webb's direction has decided to remove the provision in the Recall Petition that required two things...1) that Peter Webb be recalled, and 2) that if the Recall was successful a vote for the nominated candidates would be included on the same ballot. Did that happen? No, it did not. In an illegal Executive Session on September 13, 2021, the board under Terri Swartz's "guidance"to benefit her pal Peter Webb, advised the board members to remove the vote for a new candidate to fill Peter Webb's board seat...not his officer status...and lump it into the upcoming 2022 general board election where three seats will be filled.

This little move by Terri Swartz and Peter Webb will now severely impact the split of the 2022 upcoming vote, making the chances of filling Peter Webb's seat nothing but an afterthought. Is this what we want? Is this what the majority of this self-serving board of directors was elected to do...skew the results of the Recall replacement candidate? And where was our Association lawyer during this meeting? Why didn't she advise the board that they were meeting illegally and were breaking the rules when they chose to not only discuss this Recall Petition behind closed doors but then to modify it to their advantage? Why are we still employing this law firm? Or perhaps the law firm was silenced by Peter Webb as the rest of us are when we object?

This is just another classic case of the total autocratic control Peter Webb holds over not only the board but our entire community.

It's time to call for the order...RECALL PETER WEBB.

The open letter from Hank Kras to all DP homeowners was unwarranted and not appreciated by this homeowner. Hank can't seem to break his old habits. We homeowners don't like being talked down to and treated like we are morons. We especially don't liked being LIED to. My wife and I watched for about ten days the activity at the womens tee box while it was being moved. Lots of equipment and manpower was involved daily. Then we are told that the BOD was unaware that this was going on but of course they knew that it only cost $1900. The BOD suffers a lack of credibility and lack of trust because they spin issues to support themselves and even lie to homeowners. Is it any wonder that homeowners are pissed? Vote YES to recall Peter Webb and let's hope we can put the board on a better path next election. As Aretha Franklin said RESPECT....just a little bit.

The BOD knew or should have known about the TEE Box work. Lying about it represents fraud.

On the topic of the Rental Restriction Rule that the BOD has recently adopted: Has the BOD, and anybody else affected by the rental rule approved by DPCC have read California Civil Code 4740 and 4741? 4740 statute expressly prohibits HOA's from placing any kind of restrictions on the rental of properties. 4741 allows HOA's to place restrictions on Vacation Rentals. However, owners that have purchased their respective properties prior to the effective date of the law (i.e. January 1, 2021) are exempted from these restrictions. Also, 4741 makes HOA's that violates the statute liable for $1000 civil penalty.
